Design-Build: Additional Filter Improvements
NOTICE TO DESIGN-BUILD ENTITIES
The City of San Jose (“City” and “Owner”) hereby gives notice that, as the first step in the two-step procurement process, the City is soliciting Statements of Qualifications ("SOQs") from design-build (“DB) entities (“DB Entities”) (together with team members specified herein) to program, design, construct, and commission the Additional Filter Improvements Project (“Project”).
The City intends to use the DB method to deliver this Project, meaning that the City will select the DB Entity prior to any substantial design of the Project having been completed. The DB Entity will be selected through a two-step process as described in this Request for Qualifications ("RFQu") under Section C (Two-Step Design-Build Selection) of the Introduction to the RFQu. The City’s intent is to award a single contract (“Contract” or “Design-Build Contract”) to a selected DB Entity to deliver the Project.
All DB Entities that intend to submit a “ Proposal” for the Project during the second step of the selection process must submit a responsive SOQ package during this first step and provide to the City all materials requested as part of this RFQu process.
Following receipt and evaluation of the SOQs, the City anticipates shortlisting three
- DB Entities that the City determines best meet the qualification requirements set forth herein and will issue the Request for Proposals ("RFP") for the Project only to those shortlisted DB Entities.
Following evaluation of the Proposals received in response to the RFP, the City will select the Proposal that it determines provides the best value, based on the criteria that will be set forth in the RFP.
The successful Proposer shall agree, subject to negotiation, to a not to exceed amount for each task of the scope of services included in the first stage, which in the aggregate will equal the “Preliminary Services Fee”. Those not to exceed fees would become part of the Design-Build Contract terms. It is anticipated that the Preliminary Services Fee may be categorized into the following: Project Management, Alternatives Analysis, Preliminary Investigations, Basis of Design, 30% Design, 60% Design and 100% Design with the inclusion of expected collaborative interaction throughout Preliminary Services to inform design decisions, cost model and pricing development.
At 60% design or the appropriate point in the Design-Build Contract duration as determined by the City and the successful Proposer, a Guaranteed Maximum Price (“GMP”), or multiple
GMPs if it is determined that the Project will proceed on a phased approach, for the total Project shall be negotiated and reflected in the Design-Build Contract amendment. The City also reserves the right to negotiate either a lump-sum pricing or GMP pricing.
A.OBTAINING THE REQUEST FOR QUALIFICATIONS
The City is using Biddingo, an online bid solicitation website, to facilitate this procurement. This procurement is registered on Biddingo ( www.biddingo.com/sanjose ) under the number and name above and has the following commodity code classifications:

B.SUBMITTAL LOCATION AND DEADLINE
DB Entities must deliver to the City properly completed SOQ electronically through the following public portal:

Submittal Deadline: November 10, 2026 by 11:00 am PST
DB Entities must submit the SOQ on or before the Submittal Deadline set forth above, or as amended via any single or multiple addenda. The City will not consider late or improperly delivered SOQs. Failure to provide a properly completed SOQ before the time and date specified precludes subsequent participation in the procurement.
Please note: Attaching documentation to the solicitation will not automatically submit your SOQ. You must click the SUBMIT button before your SOQ will be submitted. Until you receive the electronic receipt for your SOQ, you have not submitted your SOQ.
DB Entities may modify their electronic SOQ prior to Submittal Deadline; however, please note that if you modify a submitted SOQ, be sure that you resubmit it prior to the Submittal Deadline. It is the sole responsibility of the DB Entity to ensure that their entire SOQ is submitted prior to the Submittal Deadline.
The City is not responsible for any late or incomplete submissions, including those due to technical issues with Biddingo. It is recommended that allow sufficient time to seek assistance from Biddingo in the event there are unforeseen issues that affect the ’ ability to upload and submit their SOQ.
C.NOTICE OF DETERMINATION
The City will issue a Notice of Determination listing the ranking order of each DB Entity, their scores, and how many of the highest-rated DB Entities will receive the RFP for the Project. DB Entities are advised that the act of submitting an SOQ is not a guarantee that the City will determine that the entity is qualified to participate in the RFP phase.
D.PROJECT LABOR AGREEMENT
This Project is subject to the Project Labor Agreement (“PLA”) between the City and Santa Clara and San Benito Counties Building & Construction Trades Council. The Contractor will be required to sign an “Agreement to be Bound” to the PLA, in a form substantially similar to that in Addendum A to the PLA, upon Contract execution and comply with the PLA throughout the duration of the Project. E.WAGE THEFT
DB Entities are expected to have read and understand the “Wage Theft Prevention Policy” adopted on April 11, 2023. A complete copy of Resolution No. RES 2023-96 can be found at https://www.sanjoseca.gov/home/showpublisheddocument/96686/638176810489930000 .
Any DB Entity in violation of the City’s “Wage Theft Prevention Policy” will be disqualified.
F.IN-USE OFF-ROAD DIESEL-FUELED VEHICLES REQUIREMENTS
This Project is subject to the California Air Resources Board (CARB) In-Use Off-Road Diesel-Fueled Fleets requirements found in California Code of Regulations, Title 13, Div. 3, Ch. 9, Art.
4.8, Sec. 2449 (“CARB Off-Road Regulations”). The awarded DB Entity will be required to submit valid Certificate(s) of Reported Compliance for itself and all designated subcontractor(s) that are using fleet(s) subject to the CARB Off-Road Regulations in performance of the DB Contract.
